By accessing or using the CabClans website and booking service, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service. You must be at least 18 years of age to make a booking.
2. Service Description
CabClans operates an online taxi booking platform serving the Melbourne metropolitan area. We connect customers with licensed Victorian taxi drivers. CabClans acts as a booking facilitator only; drivers are independent operators licensed under Victorian taxi regulations.
3. Booking Process
- Submit your booking request via our website or by calling 0430 711 111
- You will receive a confirmation of your booking
- A driver will be assigned based on availability
- Car type preference is a request only and cannot be guaranteed
4. Cancellations
You may cancel your booking at any time before pickup at no charge. To cancel, simply call us at 0430 711 111.
Please note that repeated no-shows (failing to be present at the pickup location) may affect your priority for future bookings.
5. Fares and Payment
- Payment is made directly to the driver (cash or card accepted)
- Fares are calculated by the taxi meter at Victorian standard rates
- Any price estimates provided are approximate only and not binding
- Additional charges may apply for tolls, airport fees, and booking fees as per Victorian taxi regulations
6. Passenger Responsibilities
As a passenger, you agree to:
- Provide accurate pickup and dropoff location information
- Be ready at the designated pickup time and location
- Treat drivers and vehicles with respect
- Wear seatbelts at all times during the trip
- Not smoke, consume alcohol, or use illegal substances in the vehicle
- Not transport dangerous or prohibited items
- Accept responsibility for any damage caused to the vehicle during your trip
7. Liability Limitations
CabClans operates as a booking platform that connects customers with independent, licensed taxi drivers. As such:
- CabClans is not liable for driver conduct, delays, route choices, or accidents
- CabClans is not liable for any indirect, incidental, or consequential damages
- Our maximum liability is limited to the facilitation of your booking
- Drivers carry their own insurance as required by Victorian regulations
8. Driver Obligations
- All drivers working with CabClans are licensed Victorian taxi drivers
- All vehicles are registered and insured as required by law
- Drivers comply with Victorian taxi regulations and the Commercial Passenger Vehicle Industry Act 2017
9. Service Availability
- Our booking service operates 24 hours a day, 7 days a week
- Driver availability may vary based on demand and time of day
- Service may be affected by extreme weather conditions, major events, or periods of high demand
- We cannot guarantee a driver will always be available for your requested time
10. Intellectual Property
All content on this website, including text, graphics, logos, and software, is the property of CabClans or its content suppliers and is protected by Australian intellectual property laws. The CabClans name and logo are trademarks of CabClans.
11. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising from these terms or your use of our service shall be subject to the exclusive jurisdiction of the courts of Victoria.
